Medical Device Excise Tax Lawyer?

We are looking for a tax lawyer that is familiar with the new medical device excise tax that is scheduled to go into effect in 2013.  Specifically we are seeking guidance on whether any of our products will be subject to this new tax.  Does anyone have any contacts in this area?

Thanks for your help,
Jane Kervin

Jane, Many firms, including mine, have studied the MDET, but there won't be any true experts for a few years. At the risk of oversimplifying, if the FDA classifies a product as a medical device, then it is subject to the 2.3% excise tax, subject to a few exceptions. The exceptions include: (1) sold before 1/1/2013, (2) sold outside the US, (3) sold at retail for individual use including eyeglasses, contact lenses, hearing aids, (4) for research use only, and (5) certain kit components.
