California climate bills become law
On Oct. 7, Gov. Gavin Newsom of California signed into law two landmark climate bills – the Climate Corporate Data Accountability Act (SB 253) and the Greenhouse Gases: Climate-Related Financial Risk Act (SB 261) – known collectively as the Climate Accountability Package (CAP). The CAP will require new corporate emissions and climate risk reporting.

SEC is reviewing climate rule, adopts names rule
The Securities and Exchange Commission (SEC) chair confirmed the agency is still reviewing comments about the proposed climate-related disclosure rule and would consider amendments. The SEC also finalized amendments to the Investment Company Act of 1940 names rule that includes specific provisions for ESG-related funds to combat false sustainability claims.

EPA finalizes PFAS reporting rule, updates chemical ingredients list
The rule requires manufacturers of perfluoroalkyl and polyfluoroalkyl substances (PFAS) and PFAS-containing articles to report chemical identity, uses, volumes made and processed, byproducts, worker exposure, disposal, and health and environmental risks to the Environmental Protection Agency (EPA). The EPA also added 10 chemicals to its Safer Chemical Ingredients List (SCIL).

Federal departments issue statements on UFLPA
The U.S. Department of State (DOS) and other federal departments issued an addendum to the 2021 updated Xinjiang Supply Chain Business Advisory that provides information on supply chain risks associated with state-sponsored forced labor in Xinjiang. Additionally, the U.S. Department of Homeland Security (DHS) added three entities to the Uyghur Forced Labor Prevention Act (UFPLA) Entity List, which now includes 27 companies. Finally, the chairs of the Congressional-Executive Commission on China (CECC) urged the DHS and the DOS for further implementation and enforcement of the forced labor import prohibition.
