Hawaii’s New Pay Transparency Law and Expansion of the Equal Pay Law


Hawaii’s new Pay Transparency Law and expansion of the Equal Pay Law is not just a compliance Issue. The pay legislation influences compensation, culture and communications.

Hawaii is the latest state out of a growing number of states (including CA, CO, CT, IL MD, MA, NV, NY, RI, SC and WA) to roll out, or plan to roll out, some form of pay transparency and/or pay equity laws. The objectives of these laws are to reduce or correct pay disparities among employees that perform the same or similar job duties. Hawaii employers should prepare now to be ready for 2024 in case adjustments to their pay policies and processes are needed. But undertaking a pay analysis and posting the hourly or salary ranges for job listings are just the start.  Employers should anticipate the impact of pay equity and transparency laws beyond compliance and understand how these laws drive changes in the company’s compensation strategy, culture and communications and ready a plan to navigate the company through those changes.
